Terms of Service:

I. General terms​

• Commissions for personal use only. I will require you to be upfront if the design will be for commercial use, as that is a separate matter and process. (More on this in section V).

• You must state if you would like the commission to remain private for an additional fee.

​

• I will retain full rights of my work, meaning I can still post it or use it as I wish, unless otherwise communicated. (More on this in section V).

​

• I do accept NSFW commissions at an additional price to be discussed.

​

• I will inform you how much I estimate the project to cost as well as how long it will take once I have a detailed understanding of what you want and we have come to an agreement on a general project. 

​

• I will inform you at the start if there is a queue and keep you updated of your place in line.

​

• Please be polite and respectful, I retain the right to cancel a commission for any reason. (More information on refunds provided in section IV).

• By commissioning me, you agree to these terms of service.

​

• Many of these statements and prices are negotiable, I am a flexible person just communicate with me and we can come to an agreement.​​

 

II. Payment​/Pricing

• Payment accepted over PayPal or Venmo, typically full charge upfront, or 50% upfront, 50% after sketch/ideation phase. If you have a large order or certain circumstances, I am flexible just communicate with me on your needs. However, there must be some type of deposit for me to begin work.​

• Pricing will be negotiable, but in the end I will decide if payment is fair for my work. I will work with you to figure out what we can do within your budget.

  • (Fan Art/Existing Character) Price Chart:

    • Headshot: $25

    • Half Body: $35

    • Full Body: $45

  • Original Character (add $5 to above chart)​

  • Additional Characters (+60% of above price for each addition)

    • ex: 2 full body original characters = $45+27 ($72 total)​

  • Character Background:

    • Simple (+$5)​

    • Medium (+$10)

    • Complex (+$15 or more)

III. Process​​​​

• The more references and the clearer the idea you have, the better. However,  I can help in the ideation process if you're not sure what you want.

​

• I will need to know the file size (we can talk about it if you're not sure), an idea of what you want with references, and your intentions with the project (is it to print?) before I can start. You will be charged if you decide to change the file size or general idea of the project after I have started drawing, as I may have to start over depending on the change.

​

• Work will be started once I have received the agreed upon deposit/payment.

​

• Once we have talked about your idea, I will send a sketch (or a few), at which point you can make unlimited revisions. Once the sketch is approved by you, revisions will be limited to three minor changes. If I deem it to be a major change, or too many minor changes (3+) you will be charged according to the work required for said revision. (More info in Phases below)

• Work in Progress will be sent in the form of a watermarked, low resolution JPEG after each phase.

• Phases​ 

  • 1. Ideation/Quick Sketch (unlimited changes allowed, deposit/payment needed at this stage to start)​

  • 2. Clean Sketch (unlimited changes allowed, all structural change should not move past this stage)

  • 3. Base Color (up to 3 minor changes allowed, no major or structural changes without charge)

  • 4. Final Color (no changes without charge)

    • if you opted for 50/50 payment, other half REQUIRED before I will send the final file ​

  • 5. Delivery (high resolution PNG [or file of choice] will be sent to you)

IV. Customer Satisfaction

• I will do everything I can to make you happy and adjust to your needs. I am negotiable and flexible on most things, I aim to work together with you to make your vision come to life.

• Cancellations are accpeted and I will refund your payment IF project is cancelled during the sketch phase. After this point I will have sent you a work in progress for confirmation, and if you confirm it and later decide to cancel I will only refund what I deem to be fair according to the amount of work I have already done. If I deem I've done too much work and you are cancelling way too late, I will not refund you. 

• I make frequent check ins with pictures of works in progress so I can confirm that you are satisfied with the project every step of the way.

• Speedpaint video file can be sent for small additional fee

V. Copyright/Usage Policy

• I, the artist, hold every right to the produced drawing (including works in progress and speed paint video if provided), not the client (unless otherwise communicated- this is in application to PERSONAL COMMISSIONS).​​

• Unless made a private commission for an additional fee, I have the right to use the artwork to:

  • Promote myself and my work​

  • Display/Post it as I wish

  • However, I will never sell a commissioned artwork as prints to be widely distributed without your consent

• The client is allowed to:

  • use the copyrighted artwork for personal use only unless otherwise agreed upon​

  • Print the art for personal use (not for sale)

  • Claim ownership of the character (if one of your original characters) but not the artwork itself

  • Post the art to your liking, use as a profile picture etc. but PLEASE give credit in your bio when using as a profile picture, and you MUST give credit when making a regular post of it on social media.

• The following is considered copyright infringement:

  • Reproducing/using the copyrighted artwork commercially​

  • Taking credit for creation of the artwork

  • Removing my signature

  • Altering the artwork without my consent

• A purchase of commercial rights to the artwork can be discussed with me. With commercial rights, you are allowed to make merchandise with the artwork, change it to your liking, and promote your own brand with it. Credit is still required for usage of the artwork even if altered or edited.

• Keeping the commission private can also be discussed with me.
